The Supreme Court stayed the Allahabad High Court’s order to submit the horoscope of the victim

The Supreme Court has stayed the order passed by the Allahabad High Court for the woman to submit her horoscope to the Astrology Department of Lucknow University to know her auspicious position.

Taking suo motu cognizance of the matter, the Supreme Court on Saturday asked why the astrological report was sought during the hearing of the bail plea of the accused.

It may be noted that last month, the Allahabad High Court, while hearing the bail plea of the rape accused, ordered the woman to submit her horoscope to the Astrology Department of Lucknow University to know her auspicious position.

The petitioner’s argument was that the woman is Manglik, hence she cannot be married, while the victim’s side said that the woman is not Manglik.

A bench of Justice Sudhanshu Dhulia and Justice Pankaj Mittal stayed the order of the High Court while hearing the matter.

Staying the order, the bench directed to issue notice to all the concerned parties including the state.

The court has listed the matter for next hearing on July 10.

Allowing the High Court to hear the bail plea of the accused on merits, the Court observed that “we do not understand why this astrological report is sought.”

On May 26, the Allahabad High Court, while hearing the bail application of the accused of raping a woman on the pretext of marriage, ordered the woman to submit her horoscope to the Astrology Department of Lucknow University to know her auspicious position.

The court had directed the university to submit a sealed report within three weeks. The High Court had listed the matter for further hearing on June 26.
